What is the Legal Definition of Kidnapping in NJ?
According to New Jersey criminal law, Kidnapping is
removing someone against his or her will from somewhere, usually with the intent
to hold that person for ransom or as a hostage. Kidnapping can also be not
letting someone leave from a place they were already in.
Kidnapping is also when
a person is removed from a place to make it easier to commit a different crime
or to torture or physically injure that person. It is also considered Kidnapping
when a person is held to interfere with a government event or if the purpose is
to deprive the parents or guardians of being with their child.

Kidnapping Penalties in New Jersey
Kidnapping is a second degree crime if the victims are
safely freed by the person holding them captive. A second degree crime can
result in up to 10 years in a state prison.
Kidnapping is a first degree crime if the victim is freed
by force from someone other than the person who did the kidnapping or by
escaping, if the victims are exchanged for money or goods, or if the victim is
harmed during the kidnapping. A first degree crime can result in up to 20 years
in a state prison.
There are also situations where the penalty for kidnapping
can carry a mandatory minimum sentence of 25 years in prison without parole. It
