New  Jersey Embezzlement Penalties

There is a variance in penalties for embezzlement depending upon the details of your case. The most serious classification of theft by embezzling is a 2nd degree criminal charge. This charge is a felony level indictable offense and carries a potential 10 years in prison. You could be facing this charge if you are accused of taking more than $75,000.

If the amount you are accused of embezzling is more than $500 but less than $75,000, you will face a 3rd degree criminal charge. This is also a felony but only carries a penalty reaching 5 years in prison.

If you are accused of embezzling less than $500 but more than $200, you can face up to 18 months in prison.

But a charge involving less than $200 is considered a misdemeanor level disorderly person offense and carries a potential 6 months in jail.
