Under New Jersey’s Code of Criminal Justice, robbery is defined as: Inflicting harm or force on another, or threatening to do so in the course of committing a theft. This means you can be convicted of robbery for scaring someone into giving up their property. Also, you don’t have to be successful in the theft in order to face the charge. A thwarted attempt could be classified as robbery as well.
Robbery is typically classified as a crime of the second degree. Crimes of the second degree carry a potential 5 to 10 years in prison. However, if you are armed at the time of the robbery, or if you purposefully inflict or attempt to inflict serious bodily harm, you will face charges of a robbery crime in the first degree, which carries 10 to 20 years in prison.
NJ Carjacking Laws
Related to the crime of robbery is the offense of carjacking. This is similar to a robbery charge in that you are accused of using violence or the threat of violence in order to take something that is not rightfully yours. But, carjacking refers to cases where someone’s vehicle is the object of your theft.
Carjacking is a crime in the first degree carrying up to 30 years in prison. Unlike robbery, however, carjacking also carries a mandatory minimum sentence of at least 5 years in which you are not eligible for parole.
Robbery and carjacking charges are considered serious violent crimes. They carry the possibility of a lengthy prison sentence, as well as a permanent criminal record.
