Simple Assault charges often begin in municipal court in New Jersey. Municipal courts often hear less serious criminal offenses and offenses such as traffic violations.

New Jersey Simple Assault cases are filed under NJ Statute N.J.S.A. 2C:12-1.

NJSA 2C:12-1 states that Simple Assault offenses are to be filed under specific conditions.

  • If someone attempts to cause or purposely, knowingly or recklessly causes bodily injury to another
  • When someone negligently causes bodily injury to another with a deadly weapon; or
  • A person attempts by physical menace to put another in fear of serious bodily injury

Simple Assault cases in NJ are considered less serious than Aggravated Assault Charges.

However, cases that start out as a misdemeanor Simple Assault can become much more serious.

The state may decide to indict a person initially charged with Simple Assault with Aggravated Assault – a much more serious felony offense.

Penalties For Simple Assault Charges In NJ

If you are convicted of Simple Assault charges in New Jersey, you could receive a harsh punishment.

Penalties could include up to 6 months in jail, heavy fines, restitution, probation, and even community service.

Even for a first offense Simple Assault, you could also be ordered to attend mandatory anger management classes, have electronic monitoring in-place, and lose their ability to own or possess a firearm.

This is only for Simple Assault. If the charges are enhanced and you are indicted for Aggravated Assault, the penalties are much more severe.
