You will want an experienced Trespassing Defense Lawyer in New Jersey to help you defend yourself against criminal charges in court, or to try to work out the best possible outcome.Trespassing Defense Lawyer in New Jersey

Any criminal charge should be considered serious, and can impact the rest of your life. Having a criminal conviction on your record is something to be avoided, as it can limit future job and life opportunities. Talk to a lawyer about what your risks and options are.

New Jersey Trespassing Penalties

Some of the penalties for trespassing crimes under New Jersey Laws are as follows:

Trespassing is a crime in the forth degree if it is in a home or dwelling, a school, or a research facility. You can also be charged with a forth degree crime for peering into the windows of a home or dwelling. A forth degree crime conviction carries a maximum penalty of 18 months in prison.

Trespassing (defiant trespasser) is a petty disorderly persons offense in all other cases. The statute fits if the property is marked or fenced/enclosed, or notice against trespass is otherwise given. The maximum penalty for a petty disorderly persons trespassing offense is 30 days in jail and a $500 fine.

Trespassing Defense Strategies

Some possible defenses against trespassing include:

  • the defendant reasonable and legitimately believed he had a right to be there
  • the place was open to the public, and the defendant acted lawfully in gaining access
  • the property involved is abandoned

In cases where you are charged with a 4th degree criminal offense, we may want to negotiate the charges down to a petty disorderly persons offense.

Specific defenses will always vary depending on the facts of the case. Call me and I’ll be able to provide specific details and recommendations about your particular situation.
