What’s The Penalty For Ecstasy Trafficking In New Jersey?

Ecstasy, also known as Molly, is the chemical stimulant MDMA. It’s frequently used in club settings, and has been linked to injuries and deaths for years.

Most often sold in pill form – often as a mixture with other drugs, including heroin, cocaine, methamphetamine, and more – and buyers have no way of knowing whether they’re taking MDMA, laced MDMA, or something else entirely.

Because of the dangers, New Jersey takes trafficking in Ecstasy very seriously. Even amounts of less than half an ounce carry a 3-5 year prison sentence, and fines of $75,000.

Half an ounce, up to five ounces, is more serious still, with a possible prison sentence of 5-10 years. More than five ounces of Ecstasy, whether as pills or powder, carries a sentence of 10-20 years.

Even worse, a pill that contains only a tiny fraction of MDMA is counted by weight. Not the weight of the MDMA, but the weight of the pill, so a caffeine pill spiked with some Ecstasy is weighed as a pill of Ecstasy.

What’s The Penalty For Marijuana Trafficking In New Jersey?

While New Jersey and the country are in the midst of reconsidering marijuana policies, for the time being, marijuana remains illegal here, and selling it is a serious crime.

Depending on the weight of the drugs involved, penalties may be as small as 18 months or as large as 20 years in prison.

First, “marijuana” means three different things under the law. There’s the dried plant matter (marijuana), then there’s hashish, and then there are the plants themselves. Each carry their own consequences for possession and sale.

Selling less than one ounce of marijuana, or less than 5 grams of hashish, is a Fourth Degree crime that carries a penalty of 18 months – 3 years in prison, plus fines.

Sales of more than one ounce, but less than five pounds of marijuana, or between five grams and one ounce of hashish, are Third Degree offenses, carrying potential sentences of 3-5 years in prison.

Quantities between 5-25 pounds, possession of between 10-50 plants, or possessing hashish between 1-5 pounds, is a Second Degree offense, with penalties between 5-10 years.

A First Degree marijuana trafficking offense is quantities in excess of 25 pounds, more than 50 plants, or more than five pounds of hashish.

Penalties for First Degree crimes are 10-20 years in prison, with one-third to one-half to be served without eligibility for parole.

Drug trafficking crimes in New Jersey also result in forfeiture of cars, homes, cash, and other property connected to the activity.

What’s The Penalty For Cocaine Trafficking In New Jersey?

Like most states, New Jersey punishes cocaine trafficking based on the quantity of drugs involved. For cocaine, the most serious penalties follow conviction for trafficking offenses involving five ounces or greater. This is a First Degree offense that carries a sentence of 10-20 years in prison, plus $500,000 in fines.

Trafficking in quantities of more than half an ounce, but less than five ounces, is a Second Degree crime, and carries a sentence of 5-10 years in prison, plus fines. Trafficking in less than half an ounce of cocaine carries a 3-5 year sentence, plus fines.

On top of the jail term and fines, drug offenses also carry forfeiture penalties, including cash, vehicles, and other property that the state can tie to the crime. Penalties are enhanced if the activity occurred within 1,000 feet of a school or school bus, or within 500 feet of a public park or building.
