There are a number of ways that New Jersey law criminalizes the illegal taking of property. Robbery charges are a serious offense.

Robbery (N.J.S.A. 2C:15-1) is, in essence, a crime of theft plus certain conditions.Robbery charges

Specifically, the statute reads, “A person is guilty of robbery if, in the course of committing a theft, he: (1) Inflicts bodily injury or uses force upon another; or (2) Threatens another with or purposely puts him in fear of immediate bodily injury; or (3) Commits or threatens immediately to commit any crime of the first or second degree.”

Because Robbery includes a variety of different offenses, it is a serious, second degree felony crime that carries a sentence of five to 10 years in prison and fines up to $150,000.

It can also be prosecuted as a first degree crime if the defendant attempts to kill anyone, purposely inflicts or attempts to inflict serious bodily injury, or is armed with, uses, or threatens to use a deadly weapon.

This last item is perhaps the most dangerous in our heavily armed society, as theft crimes committed with a firearm are extremely common, and can easily lead to a first degree Robbery prosecution.

Penalties For Robbery Charges In New Jersey

Penalties for robbery charges in those cases begin with a prison sentence of ten years, and longer depending on the specific facts of the matter, as well as fines of $200,000.

Will I Go To Jail As A First Offender If I’m Convicted Of Robbery (N.J.S.A. 2C:15-1) In New Jersey?

Unfortunately, a conviction for Robbery (N.J.S.A. 2C:15-1) in New Jersey carries a presumption of incarceration, and is covered by New Jersey’s No Early Release Act (NERA).

Because of NERA, not only does a first offense robbery face a prison sentence upon conviction, but they must then serve 85{74bbbd36a4df8b83bd1805c8c4f34bcc3063e84848f392c2fd8bb03fcdaa883e} of the sentence before becoming eligible for parole.

If you are convicted and sentence, for instance, to 10 years, under NERA you would have to serve eight and half years of your sentence before you would be eligible for parole.

First Degree Robbery (N.J.S.A. 2C:15-1) is one of the most significant charges a person can face in New Jersey.

What Is Armed Robbery (N.J.S.A. 2C:15-1) In New Jersey?

Under New Jersey law, Armed Robbery (N.J.S.A. 2C:15-1) is understood to be a crime of theft with the element of a threat or act of violence.

When the crime is committed with a deadly weapon, or the threat of a deadly weapon, it rises to a First Degree offense, commonly called Armed Robbery, which can lead to a prison sentence of up to 20 years.

Is Robbery The Same As Theft In New Jersey?

No, robbery and theft are distinct crimes in New Jersey. While both crimes involve taking another person’s property, only robbery is understood to be the violent taking of someone else’s property, and robbery is charged as a violent crime.

Theft, on the other hand, is simply the unlawful taking of another’s property with the intent of depriving the owner of its use.

Theft has a range of applications, from stealing personal property, to shoplifting, to identity theft crimes, to embezzlement, to obtaining goods through false pretenses.

And while robbery is charged based on the seriousness of the threat or injury, theft is usually charged based on the value of the property that was stolen.

In New Jersey, theft of property worth less than $200 is a disorderly persons offense, while goods worth between $200 and $500 are charged as a fourth degree crime.

Third degree theft is charged when the stolen property is worth between $500 and $75,000, and when the amount is greater than $75,000, you’ll be charged with first degree theft.

Is Robbery The Same As Burglary In New Jersey?

No. In New Jersey, robbery is a violent crime that includes an element of theft. Burglary is a non-violent crime characterized as unlawfully entering or remaining in a place where one is not authorized to be, with an intent to commit a crime.

Burglary, contrary to popular opinion, is not even a theft crime, but merely the crime of accessing a place without permission, with the intent of committing a crime.

Burglary is a serious crime that is charged as a third degree offense, unless factors like causing harm or threatening to cause harm are present, or possession of a deadly weapon during the commission of burglary, which will make it a second degree offense.

When a person is charged with robbery, they are alleged to have committed a theft using force or the threat of force to appropriate goods from another.

Robbery is a second degree offense that aggravating circumstances can raise to a first degree offense.
