It’s a motor vehicle violation to operate a car or truck in New Jersey if your license is suspended, or you simply never obtained a driver’s license.

How Do I Get My License Back After A Conviction For Driving While Suspended (N.J.S.A. 39:3-40) In New Jersey?

If you’ve been convicted of Driving While Suspended in New Jersey (N.J.S.A. 39:3-40), you already had a suspension on the books, and may have had extra time imposed as part of your sentence.

In any event, you’ll have to continue with the suspension, and not get caught driving again, until the suspension period ends.

You’ll also have to pay all fines, fees, and surcharges associated with both the original offense and the Driving While Suspended conviction.

Also plan to make a $100 payment to the New Jersey Motor Vehicle Commission, which handles license suspensions and restorations.

Your payment can be made at any time during or after your suspension period, and once the suspension period is up, you’ll receive a notice of restoration in the mail, which will allow you to apply for a new driver’s license.

How Much Longer Will My License Be Suspended If I’m Caught Driving While Suspended (N.J.S.A. 39:3-40) In New Jersey?

A License can be suspended for a variety of reasons in New Jersey, but it’s very common for drivers to continue driving anyway.

Lack of good public transportation in much of the state, as well as the simple convenience of using your own vehicle for errands or to get to school or work make driving a pretty irresistible option, regardless of the status of your license.

If your license has been suspended for some reason and you continue to drive, you are always at risk for being pulled over and charged with Driving While Suspended (N.J.S.A. 39:3-40).

Penalties for a first time offender are mostly monetary (a $500 fine for a first offense), but the court has the option of suspending your license for an additional six months.

What Are The Penalties For Driving While Suspended (N.J.S.A. 39:3-40) In New Jersey?

If you are caught operating a motor vehicle in New Jersey while your license is suspended, you can be charged with Driving While Suspended (N.J.S.A. 39:3-40). And this doesn’t only apply to New Jersey licensed drivers.

If you are a resident of another state where your license has been suspended and are pulled over on New Jersey’s roadways, you’ll face the same penalties as you would if you were a resident of New Jersey driving with a suspended license.

As a first offense, you’ll be fined $500 and the court has the option of revoking your license for six months, though this isn’t always done in first offense cases.

If you’re arrested for Driving While Suspended a second time, you’ll face a fine of $750 and a license suspension of up to six months.

While courts don’t usually apply the maximum suspension, multiple arrests tend to signal to the court that you may choose to re-offend.

In addition, a second conviction will carry a jail sentence of between one and five days.

As a third-time offender, you’ll face a fine of $1000, a six month license suspension, and up to 10 days in jail, or you may be assigned to community service to work off your sentence.
