The proximity to a park, public facility, or public housing bumps up your charges, so that distribution of less than an ounce of marijuana becomes a third degree crime, carrying a penalty of three to five years, plus fines.

Distribution of more than an ounce of marijuana in proximity to public facilities like parks becomes a second degree crime, with a potential sentence of five to ten years.
