Are Stolen Guns Charged Differently Than Other Theft Crimes In New Jersey?

While most theft crimes are charged based on the value of the goods stolen, stolen firearms are treated differently under the law.

Whatever the value of the firearm that’s been stolen, the theft will be charged as at least a third degree crime, which carries a potential sentence of five years.

Any firearm, whether it was purchased for $100 or $2000, automatically lands in the third degree crime category because of the seriousness of illegal weapons ending up used for other crimes.

Can A Person Be Sent To Jail In New Jersey For A Shoplifting Offense?

Yes, a third or subsequent offender of Shoplifting must be sentenced to serve a minimum of 90 days in jail.

However, a person could be sentenced to jail on a first or second offense of Shoplifting depending upon their prior criminal record.

As stated, the mandatory jail term is for third or subsequent offenders.

Is Community Service Required With A Shoplifting Conviction In New Jersey?

Yes, a person convicted of a first offense Shoplifting must be sentenced to at least 10 days of community service.

A second offender of Shoplifting must be sentenced to at least 15 days of community service.

A third or subsequent offender must be sentenced up to 25 days of community service.

Is Altering Price Tags Considered Shoplifting In New Jersey?

The answer is a qualified yes if the person also attempted to purchase the merchandise themselves or in agreement with another at less than its full retail value with the intention of depriving the merchant of all or a portion of the retail value of the merchandise.

Does Concealing Merchandise Constitute Shoplifting In New Jersey?

Yes if the concealed merchandise is coupled with the intention of depriving the merchant of the merchandise or converting the merchandise to the shoplifter without paying the merchant the value of the merchandise.

Also, a person concealing unpurchased merchandise creates a presumption of the intention of depriving the merchant of the possession, use or benefit of this merchandise without paying the full retail value.

Conceal means to conceal merchandise such that while there may be some notice of its presence it is not visible through ordinary observation.
