Will An Indecent Exposure Conviction In New Jersey Force Me To Register As A Sex Offender?

In New Jersey, indecent exposure is charged as a crime called Lewdness, and can carry significant criminal penalties.

Lewdness may be charged a disorderly persons offense, with a potential sentence of six months in county lock up and a $1000 fine.

More dangerously, charging Lewdness as a Fourth Degree Crime puts you at risk of spending 18 months in state prison and paying a $10,000 fine.

The good news is that a Lewdness charge by itself probably won’t trigger the Megan’s Law provisions requiring registry as a sex offender, but any way you look at it, these are serious charges that carry significant risk to you.

Does New Jersey Have Romeo & Juliet Protections In Cases Where A Teen Is Having Sex With A Younger Boyfriend Or Girlfriend?

Yes, New Jersey has what is known as a close-in-age exemption to sex crimes statutes that reflects the reality that a relationship between a 15 year old and a 17 year old isn’t the same as a sexual relationship between a teenager and an adult.

In New Jersey, if the difference in ages is less than four years – and both parties are older than 13 – then the facts of the case meet the definition of the close-in-age in exemption, and the older party should be in the clear.

The exemption only applies to consensual sexual relationships.

If there is evidence that either party, regardless of age, engaged in criminal sexual conduct, then charges are still possible.

What’s The Penalty For Failing To Register As A Sex Offender?

Megan’s Law is intended to provide protection to communities when people convicted of sex crimes become residents or frequent visitors because of school or work.

Offenders are required to register with local law enforcement upon changes of address, changes of employment, or changed school enrollment status. Additionally, offenders convicted of especially serious offenses must verify their address every 90 days.

Failure to register under Megan’s Law provisions in New Jersey is a third degree crime and carries a penalty of three to five years.

In addition, some of the reporting requirements carry their own penalties for failing to comply.

Offenders who don’t notify law enforcement of an address change within 10 days, or an enrollment or job change within five days, face a fourth degree crime and a penalty of up to 18 months.

In cases where release was contingent on lifetime parole supervision, failing to comply with Megan’s Law can result in revocation of parole.

What’s The Penalty For Possession Of Child Pornography?

Possessing child pornography in New Jersey is a Fourth Degree crime, which carries a sentence of up to 18 months in prison and fines of up to $10,000.

The state has an excellent record in prosecuting child pornography charges for two major reasons.

First, the defendant often voluntarily confesses or otherwise incriminates him/herself. Second, too few criminal defense attorneys in New Jersey have experience fighting these charges.

What’s The Penalty For Using The Internet To Solicit A Minor?

Using the Internet to solicit or entice a minor is known as Luring in New Jersey.

The elements of the crime include attempting, electronically or otherwise, to lure or entice a child into a motor vehicle, building, isolated area, or other place, with the intent of committing a criminal act with or against the child.

It’s important to know that simply conversing with a child over the internet does not constitute Luring, and in fact meeting a child for a meal in public may not either, assuming no criminal intent can be proved.

If you are charged with Luring, you are in an extremely dangerous situation.

As a first offense, Luring is a Second Degree crime that carries a sentence of 5-10 years in prison, plus numerous fines.

If you’ve been convicted of Luring in the past and face a new prosecution for it, you’ll be required to meet minimum sentencing guidelines that restrict your access to parole if you’re convicted again.
